"Marriage Baptism and Burial Register Act"
An Act of Council was passed at Sydney,dated the 1st of November (1825)
for the better regulating and preserving Parish and other Registers
of Births,Baptisms and Marriages and Burials in New South Wales and
Van Dieman's Land.It's leading enactments of which are as follows:-
The officiating Members of every Parish shall keep books of parchment
or of durable paper, in which shall be inserted entries of all Baptisms,
Marriages or Burials; which books shall be kept in an iron chest, to be
kept constantly locked in some dry and safe place; to be open to the
inspection of all persons on payment of one shilling,or two shillings
and six-pence for extracting a copy of any entry.
Copies of the above books shall be transmitted to the Registrar's Court
on or before the 31st of January in each year.
Persons who may wilfully insert false or forged entries, to be guilty
of felony,punishable by transportation for fourteen years.
Certificates of baptism,marriage,and burial lawfully performed by others
than the established Parochial Minister, to be transmitted to him within
one week after the solemnization of such,which are to be entered in the
books as if performed by such Parochial Minister.
From the 1st of January 1826,all burial grounds shall be removed to a
distance of at least one mile from any town or township.Ministers not
complying with this Act,to be subject to a penalty of 4 to 20 dollars.
